GENERAL TERMS AND CONDITIONS FOR RENTING QBASE EVENT HALLS

These General Terms and Conditions govern the provision of Qbase event halls for temporary paid use by the Lessor to users, hereinafter referred to as customers. These General Terms and Conditions are available on the Lessor’s website www.Qbase.bg. By submitting a request to rent one of the two event halls, the Customer declares that they are familiar with the General Terms and Conditions and accept them, as well as that they are bound by them in their respective version effective at the time of their acceptance. By making a payment according to the request made, it is considered that the Customer has unconditionally accepted the agreement and the General Terms and Conditions, and that a valid agreement with the parameters of the request is available between the parties. The General Terms and Conditions are an integral part of the agreement. The Lessor’s Tariff is part of the General Terms and Conditions.

Each of the parties expressly declares and agrees that the conclusion of an agreement and the confirmation of acceptance of the General Terms and Conditions electronically will have the same binding legal effects as the signature on the written documents and will be admissible evidence in court and any other institution for dispute settlement.

І. CREATING AN ACCOUNT

  1. During the booking, the Customer creates an account according to the parameters set by the Lessor. The Lessor approves the created account. Account approval is done entirely at the Lessor’s discretion. The Lessor has the right to refuse to approve a Customer’s account or to deactivate an already created one, including in the event that it is established that invalid documents and/or false information were provided when the account was created and/or if there are sufficient grounds to believe that the Customer is dishonest and/or there is a reasonable assumption that the rented halls are being used in a way that is incompatible with their purpose or contrary to morality, public order or applicable laws.

ІI. NECESSARY DOCUMENTS AND CUSTOMER REQUIREMENTS FOR USING THE EVENT HALLS 

  1. To rent an event hall, the Customer shall be an adult natural person or an active legal entity. When creating the account, the Customer provides their name, phone number and email address, and for a legal entity –name, Unified ID Code and company representative. The Customer also provides a bank account to which their deposit will be refunded in accordance with these General Terms and Conditions.

ІІІ. EVENT HALLS

  1. The Lessee has two event halls located in the city of Sofia, Ivan Vazov Housing Estate, 49-51 Burel Str. The halls are Q1 with an area of 70 sq.m. and Q2 with an area of 55 sq.m. Hall Q1 is located at level 0, Hall Q2 is located at level -1. The halls are suitable for holding presentations, meetings, lessons including drawing, courses in yoga, pilates, therapy sessions, workshops, etc. Each hall is equipped with folding desks, chairs, multimedia, sound system, writing board, tripods, yoga mats. The halls are air-conditioned and ventilated.
  1. The halls are booked and paid for via the website www.Qbase.bg.
  1. The halls can be rented separately or together. The minimum rental period is 1 /one/ astronomical hour.
  1. The halls are fully self-service. Customers can use any of the equipment and furniture provided. After the end of the rented period, the Customers shall put away the used equipment and furniture in the places established for them and clean and tidy up the rented hall, remove any decoration, personal belongings and documentation that have been brought into the hall.
  1. The Lessor provides the customer with complimentary Fibo purified water, tea and coffee.
  1. There is permanent video surveillance in the hall. In the event that the Customer wishes it to be turned off due to the need for confidentiality or another reason, they shall declare that they will not perform actions that are contrary to law or morality. In this case, the deposit withheld by the Lessor is increased to BGN 300. If the Customer wishes to turn off the video surveillance, the Customer shall contact the Lessor at the phone number indicated on the website.
  1. Pets are allowed in the halls only after prior agreement with the Lessor on the phone number indicated on the website. 

ІV. PRICES AND PAYMENT METHOD

  1. The rent is determined according to the Lessor’s Tariff, available on the Lessor’s website. The rent is paid 100% in advance, after the request is approved. The rent includes the rental price and use of the provided equipment, as well as the complimentary water and coffee provided by the Lessor.
  1. The rental price is paid in full in advance at the time of booking. In the event that the Customer does not use the requested event hall without withdrawing or changing the request, then according to Section V of the General Terms and Conditions the rental amount is not refunded.
  1. When creating the booking, the Customer shall also owe a security deposit in the amount of BGN 100. The deposit shall be refunded within 5 working days from vacating the hall if the circumstances specified in Chapter VII, Art. 3, 4 and 5 of the General Terms and Conditions are not present.
  1. Payment shall be made online on the Lessor’s website. The following methods of payment are allowed – directly by bank card, payment through the PayPal system or by bank transfer to the following bank account of the Lessor in United Bulgarian Bank: Premio Ltd, IBAN: BG76UBBS80021043474450.

In case of a bank transfer, the Customer shall send an electronic statement of the transfer to the Lessor’s email. If the Lessor does not receive the statement or the amount does not arrive in their account within 2 days of the booking, it is considered invalid.

  1. The Customer agrees to receive the issued invoices electronically to the email address specified by them in the created account. In this case, the invoice is considered to have been received by the Customer with the fact of sending it to the e-mail address specified by the customer. 
  1. BOOKING, CHANGE AND CANCELLATION OF BOOKING 
  1. The booking, the change and the cancellation of the booking are made through the online platform of the Lessor at www.Qbase.bg. A daily time schedule is available on the platform, from which the Customers can choose the time periods they want to use. In the schedule, the free time periods are in green, and the already booked ones are in red. Booked time periods are not subject to request.
  1. After creating a valid booking and payment by the Customer, the Lessor provides a unique access code with which the Customer will gain access to the booked hall in the requested time period.
  1. In case of cancellation of a booking made within 5 days of the rental date, the Lessor owes a refund of 50% of the rental amount, as well as the deposit paid from the customer. In case of cancellation three days or less from the rental date, the rental amount is not refunded; only the deposit paid is refundable.
  1. The Customer can change the booking made in the event that the new hours of use desired by them are available, according to the daily time schedule, and this can be done within a period not shorter than 48 hours from the time of the already made booking. The Customer shall bear in mind that depending on the Lessor’s Tariff, the new hour may be at a different price than the old one. In this case, the Customer owes an additional payment of the price. When changing the hour or day of the booking, the Lessor does not return amounts paid by the customer, regardless of the difference in prices. In this case, the Lessor generates a new access code according to Art. 2 of this section.
  1. The following types of credit/debit cards are accepted for making all payments – Eurocard/Mastercard, American Express Card, VISA Card. The Customer shall be the owner of the credit/debit card and the latter shall be valid for carrying out the authorization procedure for a period of 1 month.
  1. In the event that the Customer wishes to extend the rental period immediately after the expiration of their booked period and in the case of an available subsequent period according to the Lessee’s daily time schedule, the Customer shall make and pay a new request on the Lessor’s electronic platform.

VІ. LESSOR’S LIABILITY

  1. The Lessor provides the event hall validly booked by the customer for temporary and paid use. The hall is provided ready for use, together with the equipment described in Chapter III, item 1. The Lessor guarantees the fulfillment of all national regulations that apply to the halls provided, including building and fire regulations and provision of premises to persons with special needs. The Lessor guarantees the peaceful and undisturbed use of the rented hall in the requested time period by the Customer.
  1. 15 minutes before the expiration of the time period booked by the customer, the Lessor shall send an SMS to the Customer’s mobile phone indicated in the booking, warning them of the expiration of the time period of use.
  1. The Lessor has the right to withhold, in accordance with the Lessor’s Tariff, amounts if the circumstances under Chapter VII, Art. 3, 4 or 5 of the General Terms and Conditions are present.
  1. The Lessor is obliged to refund the deposit paid by the Customer within 5 working days of vacating the hall if the circumstances described in Chapter VII, Art. 3, 4 or 5 of the General Terms and Conditions are not present.
  1. In the event of force majeure circumstances /natural disasters, floods, earthquakes, fires, acts of war, acts of terrorism, epidemics, civil disturbances, etc./, which make it impossible or inappropriate, illegal or inexpedient to hold the Customer’s event, the parties are not liable for non-fulfillment, upon timely notification to the other party. The parties reserve the right to fulfill the stated commitments after the termination of the force majeure events. 

VIІ. RIGHTS AND OBLIGATIONS OF THE CUSTOMER. COMPENSATION

  1. The Customer has the right to use the hall, together with the equipment provided for it and in accordance with the booking and payment made. The Customer has no right to sublet the hall, nor to use it for purposes other than those requested. The Customer declares that they have performed all prior actions and obtained all prior permissions for the use of musical compositions which are subject to the intellectual property protection laws.
  1. During the time the Customer uses the hall, they are obliged to take the due care of a reasonable and conscientious owner. The Customer is liable for all damages caused to the Lessor and its property by them, their customers, guests, employees and suppliers.

The Customer declares that the organization of and holding the event organized by them is the sole and exclusive responsibility of the Customer.

  1. The Customer is obliged to leave the hall at the exact time when the booking made by them expires.
  1. The Customer is obliged to put away the equipment used by them in the designated places when leaving the hall.
  1. Before leaving the hall, the Customer is obliged to clean and remove all the equipment, decoration, personal belongings and documentation that they have brought into the hall.
  1. In case of non-fulfillment of the commitments described in item 3, item 4 or item 5 of this section, the Customer owes a penalty in the amount of BGN 100, which is deducted from the deposit paid.
  1. The Customer has the right to bring in food, drinks, flowers and/or other decoration only after agreement with the Lessor and after declaring their type and quantity in the booking.

VІІІ. DECLARATION OF THE CUSTOMER with regard to personal data processing:

By accepting these General Terms and Conditions, the Customer unequivocally and unconditionally declares the following:

  1. I confirm that the data provided by me to the Lessor, necessary for the conclusion and execution of the Agreement, are true, accurate and complete.
  1. I declare that I am fully familiar with the General Terms and Conditions and the Lessor’s Tariff, the Agreement’s terms and conditions were explained to me before signing it and I agree and accept those terms and conditions.
  1. I have read and agree to the consequences of not fulfilling my commitments, including the penalties due.
  1. By submitting the request, I give the Lessor my consent to process my personal data (ID No., first name, middle name, surname, citizenship, address, mobile phone, e-mail, etc. provided by the Customer and third parties) with automatic or other means for the purposes of concluding, administering and executing the Agreement, as well as for other purposes for which I have expressed or will express my consent in the future.
  1. I am aware and agree that when concluding and executing the Agreement, the Lessor has the right to collect, assess and otherwise process all legally owned data of the Customer. 

ІХ. MISCELLANEOUS

  1. The Lessor shall designate a contact person for the Customers:

  1. All payments under the rental agreement shall be made in Bulgarian levs.
  1. The parties will settle all disputes arising in connection with the execution of that agreement through negotiations, and if they fail to reach an agreement, the dispute will be referred to the competent Bulgarian court for settlement. The clauses of the effective Bulgarian legislation will apply for all matters not settled in that agreement.
